These Terms of Service ("Terms") are a contract between you and Datum ("Datum," "we," "us"), governing your use of the datumcost.com website and the Datum application (the "Service"). By creating an account, starting a trial, or using the Service, you agree to these Terms.
Datum reads documents you provide and turns them into a structured cost record, with trends, forecasts, and estimate checks. Datum provides cost intelligence and guidance to inform your decisions; it does not guarantee any particular bid, price, margin, or outcome, and it is not financial, accounting, or professional advice.
You must provide accurate information and are responsible for activity under your account and organization, including your users. The person who creates an organization is its owner and is responsible for its subscription. Keep your credentials secure.
If, in your first year as a paying subscriber, Datum does not surface at least four times its cost to you in identified margin risk and cost drift, we will refund the difference, subject to reasonable verification and provided your account is active and used in good faith. Details and any conditions of the guarantee will be confirmed in writing on request.
As between you and Datum, you own the documents and data you provide and the cost record derived from them. You grant Datum a limited license to host, process, and analyze that data solely to provide and improve the Service for you. We handle your information as described in our Privacy Policy. We do not sell your data or share your cost data with other builders. Business customers may request our data-processing terms.
You agree not to misuse the Service, including by attempting to breach security, reverse engineer the platform, upload unlawful content or data you lack rights to, or use the Service to build a competing product.
Datum and its software, content, and trademarks are owned by us and our licensors. These Terms do not grant you any rights in them except the limited right to use the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Datum does not warrant that outputs are accurate, complete, or that they will produce any particular result. You are responsible for your own pricing, bids, and business decisions.
To the maximum extent permitted by law, Datum will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the 12 months before the claim.
You agree to indemnify and hold Datum harmless from claims arising out of your data, your use of the Service, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or as needed to protect the Service. On termination, your right to use the Service ends; we will make your data available for export for a reasonable period where practicable.
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Douglas County, Nebraska, unless otherwise required by law.
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date; your continued use after changes take effect constitutes acceptance.
